TRADEMARK APPLICATION IN HONG KONG

Application ProcedureThe trademark may be filed together with the required documentation to the competent authority to obtain the trademark right and the protection thereof. After the application is submitted, it will go through an examination period of 4-6 months. In the event that the application is not conflict with the earlier registered or pending marks, the Registrar may accept the application, and the mark may proceed to the publication in the official gazette for opposition thereof within the prescribed period of time of three months. During the three-month period, any person/company with objection may oppose the grant of acceptance by filing a notice of opposition. Upon the expiry of publication period, the registration is valid for a period of ten years following with the issuance of a certificate and each renewal shall be for further ten (10) years.
Priority RightThe applicant may claim the priority right in Hong Kong within six (6) months from the date of filing the application in Paris Convention countries and WTO countries, territories or areas.
For the priority recognition, the applicant has to provide the following information to meet the requirements:
- The country of origin (Paris Convention countries or WTO countries) in which the application was filed.
