The Subsistence of Copyrights

When a work is created, a citizen of Mainland China, a juridical person, or other organization has the copyright, no matter such work is published or not. A foreigner or a stateless person will also have the copyright of his work in China depending on the fact whether his nation has joined any international associations related to copyright.

Valid Terms of Copyrights

Copyright of a work will last until 50 years after the creator of the work dies.
If the work is collaborated, the copyright will last until 50 years after the last creator dies.

Copyright Protection

If infringement happens, the infringer should compensate the copyrighter the exact loss. If the exact loss is hard to evaluate, the copyrighter should be compensated according to the interest the infringer gains. Also, the compensation should also include the legal action the copyrighter takes to stop the infringement.
If the exact loss of the copyrighter or the illegal interest the infringer gains is not easy to get the specific evaluation, the copyrighter will likely to get compensation no more than 500 thousands according to the court.
When copyrighters can prove that others are infringing or will infringe their copyrights and the infringement will result irretrievable loss in their legitimate rights if not being forbidden in time, they can plea the court for injunction before the prosecution.
In order to forbid the infringement, copyrighters can ask for protecting the proofs under the situation where the proofs might be vanished or be hard to acquire
